Privacy

Australian Sailing recognises that privacy is important and providing personal information is an act of trust. Australian Sailing takes that seriously, and will manage your Information only in accordance with its Privacy Policy available at: https://www.sailing.org.au/about/privacy-policy/

Individuals must promptly advise their Affiliated Club of any change of name, address or other relevant identification and contact details, either in writing or electronically.

Individuals acknowledge and consent to Australian Sailing’s use of their personal information for the purpose of sending electronically or by other means, newsletters from Australian Sailing and Affiliated Clubs, which may include information of sponsors or other third parties.

RRSRC Infrastructure Fund Donation

If I have included a tax-deductible donation to the RRSRC Infrastructure Fund it is to contribute to the ability of the club to provide quality sailing facilities for it’s members.

I would like my gift to benefit the RRSRC Infrastructure Fund and understand that my gift is made unconditionally to the Australian Sports Foundation. By making this donation I accept the Australian Sports Foundation’s Privacy Policy and Terms and Conditions. 

To the best of my knowledge, I and my relatives and associates will not benefit in any material way from this donation.

1. MEMBERSHIP DECLARATION 

I (and my family) agree to be bound by the rules of the Richmond River Sailing and Rowing Club Inc.  and understand and accept that I/we may be required to perform and undertake duties as notified. 

2. BOAT INSURANCE

Every boat racing at RRSRC must be covered with Third Party Property and Public Liability Insurance to the sum of $10,000,000 and this cover is to be maintained whenever sailing or storing a boat at RRSRC. (The insurance within SA does not cover this.) All members must be insured to compete in club races. The onus is on each member to be certain that their boat is suitably insured.

3. CONSENT OF PARENT OR GUARDIAN

By accepting these terms the Parent/Guardian of any junior member(s) nominated on the online membership form consent to their becoming a member of RRSRC and agree to be responsible for all fees payable b by them to the club and acknowledge that they have read and understand the risk notice below.

4. NEW MEMBERS

New members need to be nominated and seconded by existing club members and agreed to by the committee before membership is valid.

5. RISK WARNING

This RISK WARNING is issued jointly by the Richmond River Sailing and Rowing Club and the Waterways Authority  (trading as NSW Maritime) pursuant to the Civil Liability Act 2002 to all persons wishing to participate in the sailing activities conducted by RRSRC.

Participants are warned that, regardless of the precautions, which might be taken by reasonable and experienced persons, sailing can be a dangerous pursuit and participants are exposed to significant risk of property damage, physical harm and possibly death.

River sailing also has its own special risks.

As an indication, these risks may include, but are not limited to:

  • The extremes of weather and river conditions.  
  • The potential that control of a vessel may be lost, resulting in collision between vessels or with objects. 
  • The potential that the vessel may run aground or hit a floating or submerged object, especially after heavy rain. 
  • The sudden movement of the vessel at any time and the possibility of capsize or that participants may fall or be thrown overboard, resulting in a danger of drowning. 
  • The possibility that participants may be injured by equipment on the boat, which may include being hit by a boom, sail or rope swinging or flapping in the wind either ashore or afloat.
  • The absence of immediate medical care and the likelihood that significant delays may occur before medical care is available.
  • Exposure to the elements for extended periods.
  • Sunburn and the possibility of skin cancer from sun exposure to unprotected skin.
  • Injury or infection from standing on sharp objects in the sand or on rocks.

RRSRC and NSW Maritime also warn participants that regardless of their best intentions, they may be unable to render assistance to participants who are in distress. Participants are warned to consider the above risks and all other risks before deciding to participate in any sailing event with RRSRC.

Participants are also advised that although RRSRC is covered by third party liability insurance, the law relating to negligence and damages and the terms of the Civil Liability Act 2002 make it highly improbable that they would be successful in claiming any compensation in respect of any injury or loss sustained as a result of participating in a RRSRC event. Also participants are not covered under any insurance policy held by RRSRC for any injury or damage that they may cause as a result of their participation in the RRSRC event.

Any participant who considers that they have a need for insurance must make their own private arrangements with an insurer.

It is noted that a personal accident insurance policy is available with subscription to membership of Yachting NSW.

Acknowledgement

By agreeing to these terms I confirm that:

  • I will abide by the members declaration,
  • I have suitable insurance for the above boat and will keep it insured while participating or storing it at the club and that
  • I give consent for any juniors noted in my application and that
  • I have read the risk warning and agree to accept the risks associated with the sport of sailing and 
  • I agree to follow the RRSRC Covid-safe plan, and
  • Acknowledge that none of NSW Maritime nor Richmond River Sailing and Rowing Club nor any employee, official, volunteer or member of those bodies will be liable in any way in relation to the death, bodily injury, loss or damage which may be suffered or incurred by me or the minors for whom I am responsible as a result of our participation in any RRSRC event.

You can help reduce risk to yourself and any minors whom you supervise by following these guidelines:

  • Always wear a life jacket and adequate sun protection and carry water while sailing.
  • Always wear footwear while sailing or on the beach or club premises.
  • Always examine the sand you intend to walk on and look out for sharp objects.
  • Always check the weather forecast before going sailing. You are responsible for the decision as to whether to sail or continue sailing and for ensuring the people on your boat are competent for the conditions. Wear warm clothes in cold or windy weather and carry drinking water.
  • Do not run or skylark when around the RRSC, especially on the front and back steps.
  • Beware of flapping sails and swinging booms while sailing and on land.
  •  The RRSRC is not responsible for supervising minors while ashore. This is the responsibility of their parents or delegated adult.

BOAT STORAGE AGREEMENT

Boat storage must be approved by the rear Commodore or rowing officer in the case of rowing boats before paying storage fees

Please Note: In renewing your Boat Storage arrangement you are reminded of the terms of clause 5 below.

  1. That the rental charge for storage will be paid in advance at the rate fixed by the Club from time to time.
  2. That the boat shall display its name
  3. That the boat and its gear will be stored only in such racks or places as the Club’s Committee may direct.
  4. That the Club may cause the boat and its gear to be moved to such other racks or places within its boat shed or yard as the Club’s Committee may direct.
  5. Priority in allocation of club spots is given to sailing boats that participate regularly in the club's sailing activities. Owners of craft that in the opinion of the Club Committee are not in this category may be asked to remove their craft from the clubhouse during the season, in which case a pro-rata refund of storage fee will be paid.
  6.  That, in the event that:-

         ïƒ˜ A written or emailed request is made for you to remove your craft from the clubhouse or yard under clause 5 or otherwise and you have not done so within one month; or

         ïƒ˜ You neither have removed the craft from the boat shed or yard nor entered into a further rental agreement by the 30th September 2019. the Club may, without reference to you:-

             a) remove the craft from the club property to any place deemed appropriate: and/or -

             b) dispose of the boat by giving good title thereto by sale, gift charter of any other means without being liable to me for any financial consideration arising from such disposal.

       7. That I will hold the Club, its members and its officers harmless in respect of any damage, loss or injury suffered by the boat, its gear or any person as result of the boat being stored in the Club’s Boatshed or yard.
